Contract law determines how agreements in business are enforced by either party. A contract is defined in Australia as a legally enforceable promise made by one party to another for valuable consideration which is usually money. The parties must be legal entities which includes individuals and limited companies.

Contract law deals with interpreting and enforcing legally binding agreements which, in most cases do not need to be in writing to be enforceable. The main exception to this under Australian law relates to a transaction involving land or real property which must have a written agreement, signed by both parties, containing details of the parties, the property and the price, before it is legally enforceable.

Contract law cases, by design, provide a definitive interpretation of the law and effectively clarify and amend legislation until the law is reconsidered.
