Interpreting & Enforcing Contracts

Contract law deals with interpreting and enforcing legally binding agreements which, in most cases do not need to be in writing to be enforceable. The main exception to this under Australian law relates to a transaction involving land or real property which must have a written agreement, signed by both parties, containing details of the parties, the property and the price, before it is legally enforceable.

Stautes serve as the starting point for the interpretation of business agreements. New legislation is passed by lawmakers with the intention that the existing law will be clarified. Contract law cases, by design, provide a definitive interpretation of the law and effectively clarify and amend legislation until the law is reconsidered.
